Sparrow Acoustics' software is not intended to diagnose, prevent, cure, alleviate or treat any disease or health condition, or investigate, replace or modify anatomy or any physiological process, or to be a substitute for professional medical care. Our sound processing and visualization are intended for informational and educational purposes only. Sparrow Acoustics' software has not been tested with individuals with health conditions, is not a medical device and has not been cleared or approved by the U.S. Food and Drug Administration or Health Canada.
Sparrow Acoustics does not guarantee that any person receiving educational information and/or training from the system will achieve any particular skill level or the necessary proficiency to qualify for any license, certificates or ratings issued by any regulatory agency or government authority. Your use of the system is with full knowledge and awareness that you waive any claim you may have against Sparrow Acoustics for reliance on any information or training presented through the system.
Sparrow Acoustics, Inc. (“we”, “us” or “Sparrow Acoustics”) is committed to protecting your privacy. This Privacy Policy describes how we collect, store, use and distribute information through Sparrow Acoustics software, websites, documentation, and related services (together, the “Services”).
By using the Services, you consent to the use of your Personal Information as described in this Privacy Policy. You may withdraw your consent to our processing of your Personal Information at any time by stopping use of Sparrow Acoustics’s products, deleting your data, or deleting your account.
The Effective Date of this Privacy Policy is May 13, 2020.
This Privacy Policy supersedes any prior agreements or earlier versions of this Privacy Policy between you and Sparrow Acoustics for the use of the Services.
The Services are directed solely to persons 18 years of age or older, and we do not knowingly gather Personal Information from visitors who are under 18. If we become aware that we have gathered Personal Information from a person under 18, then we will attempt to delete such information as soon as possible. If you believe that we have gathered Personal Information from a person under 18, please contact us at cs@sparrowacoustics.com.
Personal Contact Information. By their nature, the Services track certain data that may be used to identify you individually.

Your Full NameThis is the only information you have to provide to create an account with us.
You have an option to use the limited version of the software without a collection of your personal contact information by using the software without authorization.
If you are uncertain about which Personal Data Sparrow Acoustics is collecting, you are welcome to contact the us at cs@sparrowacoustics.com.
Usage and Analytics Information. The only usage information that is being collected is log data. As with most technology services and websites delivered over the Internet, our servers automatically collect information when you access or use our Services and record it in log files. This log data may include the Internet Protocol (IP) address, address of the webpage which is linked to the Service being requested, browser type, the date and time the Services were used, and operating system of your device. This type of information is only collected in anonymized or aggregated format, and is not personally identifiable.
User Uploaded Data. You can upload your sound files while using our application. We do NOT collect or store any data that you uploaded during the usage of the application, including the sound files and any patient-related information. Files you uploaded in order to use our application will be automatically deleted when you log out or close the application.
Cookies. We do not use cookies in our applications to collect your information.
Collected Information allows Sparrow Acoustics to provide its Services, as well as used for the following purposes: advertising, content performance and features testing, Infrastructure monitoring, registration and authentication, analytics and contacting you.
If we decide to use Collected Information in the future for any other purposes not identified below, we will only do so after informing you by updating this Privacy Policy.
Personal Contact Information. We use your Personal Contact Information to manage your account, to provide the Services, to maintain our customer/visitor lists, to respond to your inquiries or request feedback, for identification and authentication purposes, to send you administrative notifications (such as security, support or maintenance advisories), for service improvement, for administering and improving our Services to you, tracking outages or troubleshooting issues that you report to us, and to address issues like malicious use of the Services.
From time to time, we may use your personal information to send important notices, such as communications about purchases and changes to our terms, conditions, and policies. Because this information is important to your interaction with Sparrow Acoustics, you may not opt out of receiving these communications.
We might want to contact you with information about product announcements, general company news, software updates and special offers, and we may want to contact you with information about products and services from our business partners. This type of communication requires your consent, and you may opt out of such communications at any time by clicking the “unsubscribe” link found within Qardio email updates, reaching out to our Customer Support team, or by changing the settings in your profile inside of Sparrow Acoustics applications.
We do not actively collect Personal Contact Information for the purpose of sale of such information in a way that specifically identifies the individual (i.e. we don’t sell customer lists).
Usage and Analytics Information. We use this information to administer and improve our Services to you. We may also use your Usage and Analytics Information in a de-identified, anonymous way in conjunction with an analytics service such as Google Analytics to monitor and analyze use of the Services, for the Services’ technical administration, to increase the Services’ functionality and user-friendliness, and to verify users have the authorization needed for the Services to process their requests.
Other Data. In some of our email messages, we use a “click-through URL” linked to content on the Sparrow Acoustics websites. When you click one of these URLs, they pass through a separate web server before arriving at the destination page on our website. We track this click-through data to help us determine interest in particular topics and measure the effectiveness of our customer communications. If you prefer not to be tracked in this way, you should not click text or graphic links in the email messages.
Pixel tags enable us to send email messages in a format customers can read, and they tell us whether mail has been opened. We may use this information to reduce or eliminate messages sent to customers.
Our software does not support “Do Not Track” requests. To determine whether any of the third-party services it uses honor the “Do Not Track” requests, please read their privacy policies.
We will keep your Personal Information for as long as it remains necessary for the identified purpose or as required by law, which may extend beyond the termination of our relationship with you. We may retain certain data as necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally-identifiable data, account recovery, or if required by law. All retained Personal Information will remain subject to the terms of this Privacy Policy. Please note that if you request that your Personal Information be removed from our databases, it may not be possible to completely delete all of your Personal Information due to technological and legal constraints.
Customer’s Instructions. Sparrow Acoustics will solely share and disclose your Personal Data in accordance with your instructions and in compliance with applicable law and legal process.
Third Party Service Providers and Partners. We may engage third party companies or individuals as service providers or business partners to process other information and support our business. These third parties may, for example, provide maintenance, virtual computing and storage services.
At this moment we don’t allow integrations with third-party providers allowing you to todice to share your data with them.
Image Downloads. We allow you to download the images made by our software to your local machine, but it’s solely your responsibility if afterwards you share the downloaded images with others. Sparrow Acoustics does not control how you or any other third parties choose to share or disclose Information.
Corporate Affiliates. Sparrow Acoustics may share other information with its corporate affiliates, parents and/or subsidiaries.
Change to Sparrow Acoustics’s Business. If Sparrow Acoustics engages in a merger, acquisition, bankruptcy, dissolution, reorganization, sale of some or all of Sparrow Acoustics’s assets or stock, financing, public offering of securities, acquisition of all or a portion of our business, a similar transaction or proceeding, or steps in contemplation of such activities (e.g. due diligence), some or all information may be shared or transferred, subject to standard confidentiality arrangements.
Law and Order. Your Personal Data may be used for legal purposes by Sparrow Acoustics in Court or in the stages leading to possible legal action arising from improper use of the Services. You declare to be aware that Sparrow Acoustics may be required to reveal your personal data upon request of public authorities. We may disclose your information to third parties if we determine that such disclosure is reasonably necessary to comply with the law; protect any person from death or serious bodily injury; prevent fraud or abuse of us or our users; or protect our property rights.
International Data Transfers. Sparrow Acoustics Services are hosted in the United States and are intended primarily for visitors located within the United States. If you choose to use the Services from other regions of the world, laws governing data collection and use that may differ from U.S. law, then please note that you may be transferring your Personal Information outside of those regions to the United States for storage and processing. By providing your Personal Information through the Services, you consent to such transfer, storage, and processing.
The security of your Personal Information is important to us. We use commercially reasonable efforts to store and maintain your Personal Information in a secure environment. We take technical, contractual, administrative, and physical security steps designed to protect Personal Information that you provide to us. We have implemented procedures designed to limit the dissemination of your Personal Information to only such designated staff as are reasonably necessary to carry out the stated purposes we have communicated to you.
You are also responsible for helping to protect the security of your Personal Information. For instance, never give out your password, and safeguard your user name, password and personal credentials when you are using the Services, so that other people will not have access to your Personal Information. Furthermore, you are responsible for maintaining the security of any personal computing device on which you utilize the Services.

You have the right to access the Personal Information we hold about you in order to verify the Personal Information we have collected in respect to you and to have a general account of our uses of that information. Upon receipt of your written request, we will provide you with a copy of your Personal Information, although in certain limited circumstances we may not be able to make all relevant information available to you, such as where that information also pertains to another user. In such circumstances we will provide reasons for the denial to you upon request. We will endeavor to deal with all requests for access and modifications in a timely manner.
Sparrow Acoustics reserves the right to make changes to this privacy policy at any time by giving notice to you on this page and within the software application and/or - as far as technically and legally feasible - sending a notice to you via any contact information available to Sparrow Acoustics. When we make changes to the Privacy Policy, we will always ask you to review and consent with it before proceeding to use our products.

These Terms & Conditions (“Terms”) supersede any prior agreements or earlier versions of these Terms between you and Sparrow Acoustics Inc. (“Sparrow Acoustics”) for the use of Sparrow Acoustics’ software, websites, documentation, and related services (together, the “Services”).
Thank you for using Sparrow Acoustics! Please carefully read the following Terms before using the Sparrow Acoustics’ Services. By accessing and using the Services, you acknowledge that you have read, understood and agree to be bound by these Terms which form an agreement that is effective as if you had signed it. If at any time you do not agree to these Terms, please do not access or use the Services or any of its content. Each time you access, use or browse the Services, you signify your acceptance of the then-current Terms. If you register for or otherwise use our Services, or purchase any products or services from Sparrow Acoustics, you shall be deemed to confirm your acceptance of the Terms and your agreement to be a party to this binding contract. If you’re using our Services for an organization, you’re agreeing to these Terms on behalf of that organization.
Your access to, use of and browsing of the site and its contents are subject to all terms of use contained herein and all applicable laws and regulations. if you do not agree to these terms of use, you won”t be granted permissions to access the services.

You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purpose, any portion of the Services or the Content other than as expressly authorized by Sparrow Acoustics Inc. in writing. You may not duplicate, publish, modify, distribute, perform or create derivative works from any part of the Services or the Content unless expressly authorized by Sparrow Acoustics Inc. Use of the Services or the Content in any way not expressly permitted by these Terms is prohibited, and may be actionable under United States or international law. You agree not to access the Services by any means other than through a standard web browser. You agree that you will not remove or modify any acknowledgements, credits or legal notices contained on the Services or in the Content.
Special terms may apply to some products or services offered on the Services, or to any sweepstakes, contests or promotions that may be offered on the Services. Such special terms (which may include official rules) may be posted in connection with the applicable product, service, sweepstakes, contest, promotion, feature or activity. Any such special terms are in addition to these Terms and, in the event of a conflict, any such terms shall prevail over these Terms.
We encourage you to use a distinct and non-obvious username and password combination that is different from what you use for other services. You are responsible for maintaining the accuracy, completeness and confidentiality of Your Information, and you will be responsible for all activities that occur under your account, including activities of others to whom you have provided Your Information. We will not be liable for any loss or damage arising from your failure to provide us with accurate information or to keep Your Information secure. If you discover any unauthorized use of Your Information or suspect that anyone may be able to access Your Information, you should immediately change your password and notify our Customer Support team.
In order to use Sparrow Acoustics’s products on a variety of computing devices, you’ll need to use your computers, tablets or phones. Sorry, but obtaining those devices and paying for their connectivity and data plans is your responsibility. Sparrow Acoustics also has no responsibility for the availability of the Internet and other telecommunication services necessary to access the Services or for the functioning of the Services.
By using our Services you agree that the exclusions and limitations of liability set out in our Services Disclaimer are reasonable. If you do not think they are reasonable, you must not use the Services.
Unless the following restrictions are prohibited by law, you agree not to reverse engineer or decompile the Services, attempt to do so, or assist anyone in doing so.
Without limiting the foregoing, you are responsible for taking all necessary precautions to insure that any Content or access to the Services is free of viruses or other harmful code.
Prohibited Actions: You agree that the following actions are prohibited and constitute a material breach of these Terms. This list is not meant to be exhaustive, and Sparrow Acoustics Inc. reserves the right to determine what types of conduct it considers to be inappropriate use of the Services. By way of example, and not as a limitation, you agree that when using the Services, you will not:
Services and their content and the information, services, products offered for sale and materials and activities contained in or advertised on the services, including without limitation text, graphics and links, are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. To the maximum extent permitted by law, sparrow acoustics inc. and its suppliers and related parties disclaim all representations and warranties, express or implied, with respect to such information, services, products and materials, including, but not limited to, warranties of merchantability or fitness for a particular purpose, title, non-infringement, freedom from computer virus and implied warranties arising from course of dealing or course of performance. Without prejudice to the generality of the foregoing paragraph, Sparrow Acoustics does not warrant that: services will be constantly available, or available at all; or the information on the Services is complete, true, accurate or non-misleading.
Nothing in Services constitutes, or is meant to constitute, advice of any kind as specified in our Non-Medical Use Disclaimer. If you require advice in relation to any medical matter you should consult an appropriate professional.
To the maximum extent permitted by law, Sparrow Acoustics Inc. and its related parties disclaim all liability, whether based in contract, tort (including without limitation negligence), strict liability or any other theory arising out of or in connection with the Services, use, inability to use or performance of the information, services, products and materials available from the Services. In no event shall Sparrow Acoustics Inc. or any of its affiliated entities or suppliers be liable
These limitations shall apply notwithstanding any failure of essential purpose or the existence of any limited remedy. These limitations of liability apply even if Sparrow Acoustics has been expressly advised of the potential loss. The maximum aggregate liability of Sparrow Acoustics Inc. arising out of or in connection with these Terms & Conditions or the Services shall not exceed fifty dollars (U.S.).
User Materials. Any content, views, sounds downloaded, print-screened, shared, transmitted or otherwise made available by users through or outside of our Services (“User Materials”) are strictly those of the originating author, who is solely responsible for its content. Use of or reliance on User Materials is entirely at your own risk. Sparrow Acoustics Inc. does not endorse any User Materials nor vouch for their reliability. Under no circumstances will Sparrow Acoustics Inc. be liable in any way for any User Materials. You acknowledge that Sparrow Acoustics Inc. may or may not pre-screen User Materials, but that it and its designees have the right (but not the obligation) in their sole discretion to pre-screen, refuse, delete and/or move any User Materials that are available via the Services. Without limiting the foregoing, Sparrow Acoustics Inc. and its designees have the right to remove any User Materials that violate these Terms or are otherwise objectionable in Sparrow Acoustics Inc.’s sole discretion. Sparrow Acoustics Inc. shall have no liability for such removal.
If, through accessing or using the Services, you utilize or obtain any product or service from a third party, you may additionally be subject to such third party’s terms and conditions applicable thereto, and these Terms shall not affect your legal relationship with such third party.
We are NOT providing you with “covered health services” as such term is defined in the Health Insurance Portability and Accountability Act (“HIPAA”). Any information that you provide to us will NOT be deemed in any way “protected health information.” We are not obligated to handle that information in the manner required by HIPAA. You agree to never make any HIPAA claims against us.
These Terms set forth the entire understanding and agreement between you and Sparrow Acoustics Inc. with respect to the subject matter hereof. If any provision of the Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms shall remain in full force and effect. Headings are for reference only and in no way define, limit, construe or describe the scope or extent of such section. Sparrow Acoustics Inc.’s failure to act with respect to any failure by you or others to comply with these Terms does not waive its right to act with respect to subsequent or similar failures. You may not assign or transfer your rights or obligations under these Terms without the prior written consent of Sparrow Acoustics Inc., and any assignment or transfer in violation of this provision shall be null and void. There are no third party beneficiaries to these Terms.
You agree to indemnify, defend and hold Sparrow Acoustics Inc., its officers, directors, employees, agents, subsidiaries, affiliates, licensors, service providers and others acting in concert with it, harmless from any loss, liability, claim or demand, including without limitation reasonable attorneys' fees, made by you or on your behalf or by any third party due to or arising out of (a) your connection or submission to or use of the services or the content; or (b) your violation of these terms of use, any applicable laws, or the rights of Sparrow Acoustics Inc. or any third party. you agree that you will not bring any claim personally against Sparrow Acoustics’ officers or employees in respect of any losses you suffer in connection with the services.
You acknowledge and agree that, as between Sparrow Acoustics and you, all right, title, and interest in and to the Services and the Content, including without limitation any patents, copyrights, trademarks, trade secrets, inventions, know-how, and all other intellectual property rights are owned exclusively by Sparrow Acoustics Inc. or its licensors and are protected by United States intellectual property laws and other applicable laws.
Copyright: All Content included in the Services, such as text, graphics, logos, icons, images, media, data, audio, animation, algorithms, software and other information and materials, is the copyright and property of Sparrow Acoustics Inc. or its content suppliers and protected by U.S., Canadian and international copyright laws. Permission is granted to electronically copy, download and print hard copy portions of the Services for the sole purpose of using the Services as a training and informational resource or using the Services for personal information. Any other use, including the reproduction, modification, distribution, transmission, republication, display or performance, of the Content of the Services, is strictly prohibited.
Trademarks: The trademarks, service marks, logos, slogans, trade names and trade dress used on the Services and downloadable materials are proprietary to Sparrow Acoustics Inc. Any third party names or trademarks referenced in the Services do not constitute or imply affiliation, endorsement or recommendation by Sparrow Acoustics Inc. or of Sparrow Acoustics Inc. by the third parties.
We welcome feedback, but note that we may use comments or suggestions without any obligation to you.
Any links to third party websites in the Services are provided for convenience. We are not responsible for the content of or any actions taken by those third party websites.
Sparrow Acoustics Inc. may, in appropriate circumstances and at its sole discretion, disable and/or terminate use by users who infringe the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please write Sparrow Acoustics Inc. at cs@sparrowacoustics.com.
Sparrow Acoustics retains the right, in our sole discretion, to modify or discontinue, temporarily or permanently, the Services, or any portion thereof, with or without notice. to implement new elements as part of and/or ancillary to the Services and any software applications, including changes that may affect the previous mode of operation of the Service. We expect that any such modifications will enhance the overall Services, but it is possible that you may not agree with us. We also reserve the right to establish limits to the nature or size of storage available to you, or your continued ability to access or share, Your Information and other data, and impose other limitations at any time, with or without notice. You agree that Sparrow Acoustics Inc. shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Services.
You’re free to stop using our Services at any time. We also reserve the right to suspend or end the Services at any time at our discretion and without notice. For example, we may suspend or terminate your use of the Services if you’re not complying with these Terms, or use the Services in a manner that would cause us legal liability, disrupt the Services or disrupt others’ use of the Services. We reserve the right to terminate and delete your account if you haven’t accessed our Services for 12 consecutive months. We’ll of course provide you with notice via the email address associated with your account before we do so.
In order to use certain features of the Site, you may have to register and create an account with Cardiogram Inc... You are responsible for maintaining the confidentiality of any passwords associated with your Cardiogram Inc. account, you agree to monitor all activity under the account and you assume full responsibility for all activities that occur under your account (except as to security breaches caused by Cardiogram Inc.). Cardiogram Inc. reserves the right, at its sole discretion, immediately and without notice, to suspend or terminate your access to the Site for any reason, including without limitation any breach by you of these Terms. You agree that Cardiogram Inc. shall not be liable to you or any third party for any such suspension or termination.
We strive to provide you with Services that you will enjoy using. However, we understand that sometimes you may not be satisfied with the Services. We both agree to use our best efforts to resolve any dispute between us in an amicable manner. We want to address your concerns without needing a formal legal case. Before filing a claim against Sparrow Acoustics, you agree to try to resolve the dispute informally by contacting cs@sparrowacoustics.com. We’ll try to resolve the dispute informally by contacting you via email.
These Terms shall be governed by, and will be construed under, the laws of the State of Massachusetts, U.S.A., without regard to choice of law principles. You irrevocably agree to the exclusive jurisdiction by the federal and state courts located in or for Boston County, in the State of Massachusetts, U.S.A., to settle any dispute which may arise out of, under, or in connection with these Terms, as the most convenient and appropriate for the resolution of disputes concerning these Terms. Any cause of action or claim you may have with respect to these Terms, Sparrow Acoustics Inc., the Services or their Content must be commenced within six (6) months after the claim or cause of action arises or such claim or cause of action shall be barred.
You and Sparrow Acoustics Inc. agree that each of us may bring claims against the other only on an individual basis and not as part of any purported class or representative action or proceeding. We refer to this as the “prohibition of class and representative actions.” Unless both you and we agree otherwise, the arbitrator may not consolidate or join your or our claim with another person’s or party’s claims, and may not otherwise preside over any form of a consolidated, representative or class proceeding. You may only resolve disputes with us on an individual basis, and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class actions, private attorney general actions, and consolidation with other arbitrations aren’t allowed.
The Services are controlled within the United States of America. Those who choose to access the Services from locations outside of the United States do so on their own initiative, and are responsible for compliance with local laws if and to the extent local laws are applicable. Sparrow Acoustics Inc. does not represent that the Services or Content are appropriate outside the United States of America.
Sparrow Acoustics Inc. shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control or unforeseen circumstances such as acts of nature or God, fire, flood, earthquake, accidents, strikes, war, terrorism, governmental act, failure of common carriers (including without limitation Internet service providers and web hosting providers), or shortages of transportation facilities, fuel, energy, labor or materials.
Changes in these Terms are almost certain to happen. If we make a change, we’ll announce changes here at our site and ask you to review and accept the new Terms, and we also may elect to notify you of changes by sending an email to the address you have provided to us. We will also try to explain the reasons for the change.
If we do update these Terms, you are free to decide whether to accept the terms or to stop using our Service; your continued use of the Service after the effectiveness of that update will be deemed to represent your agreement with, and consent to be bound by, the new Terms.
